This Terms of Service (hereinafter referred to as the "Agreement") establishes the terms and conditions for the use of online store (hereinafter referred to as the "Service") provided by RISA wonders (hereinafter referred to as the "Company") on this website. Users (hereinafter referred to as "Users") are requested to use the Service in accordance with this Agreement.

 Article 1 (Application and Amendment of the Agreement)

  1. This Agreement shall apply to all relationships related to the use of the Service between the Users and the Company.
  2. By applying for user registration defined in Agreement, Users are deemed to have agreed to Agreement.
  3. Company may arbitrarily change Agreement, and in such cases, Company shall notify the content of such change in advance by notifying the Users in a manner prescribed by the Company, and such change shall have effect immediately upon notification.

 Article 2 (User Registration)

  1. User registration shall be completed when the applicant for registration applies for registration through the method specified by the Company, and the Company approves the registration by notifying the applicant of such approval in accordance with the criteria set by the Company.
  2. The Company may not approve the registration of an applicant if the Company determines that any of the following reasons apply, and the Company shall not have any obligation to disclose the reasons:
    • If there is any false, incorrect, or omitted information in the registration details provided to the Company.
    • If the applicant is a minor, an adult ward, a person under curatorship, or a person under assistance and has not obtained the consent of their legal representative, guardian, curator, or assistant.
    • If the Company determines that the applicant is a member of an anti-social force or organization (including but not limited to organized crime groups, gang members, right-wing groups, anti-social forces, or other similar entities) or is involved in any form of interaction or involvement with anti-social forces or organizations through funding or other means to support, operate, or manage anti-social forces or organizations.
    • If the applicant is a person who has violated a contract with the Company in the past or is a related party thereof, as determined by the Company.
    • If the applicant has been subject to measures under Article 8.
    • If the Company determines that it is not appropriate to approve the registration for any other reason.

 Article 3 (Management of User ID and Password)

  1. The Users shall be responsible for the management of their user ID and password for the Service at their own responsibility.
  2. The Users shall not transfer or lend their user ID or password to any third party under any circumstances. If a combination of the user ID and password matches the registration information and is used to log in, the Company will consider it as the use by the Users who registered the user ID.
  3. The Users shall be responsible for any damages caused by inadequate management of the user ID or password, misuse, or use by a third party, and the Company shall not be liable for any such damages.

 Article 4 (Usage Fees and Payment Methods)

  1. The Users shall pay the usage fees for the use of the Service as separately determined by the Company and displayed on this website, in the method specified by the Company.
  2. The Company may change the usage fees during the period of use of the Service.
  3. In the event that the Users delays the payment of the usage fees, the Users shall pay a delay damages fee at a rate of 6% per year.

 Article 5 (Use of the Service)

  1. The terms and conditions for the use of the Service shall be as follows:
    • Shipping fees: As specified on the website.
    • Establishment of the contract: At the time when the "Order Confirmation Email" is sent from the Company.
    • Purchase receipt: The "Order Confirmation Email"

Article 6 (Prohibited Activities)

  1. Users shall not engage in the following activities when using the Service:
    • Actions that violate laws or public order and morals.
    • Actions related to criminal activities.
    • Actions that damage or obstruct the function of the Company's servers or networks.
    • Actions that may hinder the operation of the Company's service.
    • Actions to collect or store personal information of other users.
    • Actions to impersonate other users.
    • Actions that directly or indirectly provide benefits to anti-social forces related to the Company's service.
    • Actions that violate the purpose of using this Service.
    • Other actions deemed inappropriate by the Company, such as those that may cause hindrance to the provision of this Service by the Company or third parties or may cause damage to the Company or third parties by the User's actions.

 Article 7 (Suspension of Service)

  1. If the Company determines that any of the following reasons apply, the Company may suspend or interrupt all or part of the provision of the Service without prior notice to the Users:
    • When conducting maintenance or updating of the computer system related to the Service.
    • When it becomes difficult to provide the Service due to force majeure such as earthquakes, lightning, fires, power outages, or natural disasters.
    • When computers or communication lines are stopped due to accidents.
    • When the Company otherwise determines that it is difficult to provide the Service.
  1. The Company shall not be liable for any disadvantage or damage suffered by the Usersor a third party due to the suspension or interruption of the provision of the Service, unless the Company has intentional or gross negligence.

Article 8 (Restriction of Use and Deregistration)

  1. The Company may, without prior notice, restrict the use of all or part of the Service or delete the User's registration as Users if any of the following apply:
    • When the Users violates any provision of these Terms of Use.
    • When it is found that false information has been registered in the User's registration information.
    • When the Company otherwise determines that the use of the Service by the Users is inappropriate.
  1. The Company shall not be liable for any damage suffered by the Users as a result of actions taken by the Company based on this article.

Article 9 (Disclaimer)

  1. The Company shall be exempt from liability for non-performance of its obligations and any kind of liability if such non-performance is not due to the Company's intentional or gross negligence.
  2. Even if the Company is liable for any reason, the Company's liability shall be limited to damages within the usual range and, in the case of a paid service, within the amount of the fee (or the equivalent of one month's fee for continuous services).
  3. The Company shall not be liable for any dispute arising between the Usersand other users or third parties regarding the Service, and the Users shall resolve such disputes at their own risk and responsibility.

Article 10 (Changes to Service Content, etc.)

  1. The Company may change the content of the Service or suspend the provision of the Service without notifying the Users, and shall not be liable for any damages incurred by the Users as a result. 

Article 11 (Payment)

  1. Payment can be made by one of the following methods:
    • Credit card payment (Mastercard, VISA, American Express)
    • Shop Pay
    • Apple Pay
    • Google Pay
    • Bancontact
    • iDEAL
  1. The payment deadline for each payment method is as follows:
    • Credit card payment: Payment will be settled immediately. However, the purchase data will be reflected at the end of the purchase month, even though the date of the order or reservation is the completion date of the payment. For information regarding the card withdrawal date, please contact your credit card company directly. 

Article 12 (Returns and Exchanges)

  1. We do not accept changes or cancellations of orders, or exchanges and returns due to the customer's convenience such as errors in order details, or variances from the customer's expectations after the order has been placed and the product has been delivered.
  2. While we strive to ensure the perfect delivery of your order, in the unlikely event that the received product is damaged or soiled due to our fault or responsibility, or if it differs from the product you ordered, please contact us through the contact form and return the item to us at cash-on-delivery if you are located within Japan. After receiving the returned item, we will promptly exchange it for a new product. If a replacement product is not available, we will provide a refund. However, please note that the following items cannot be returned under any circumstances:
    • If fail to contact us within 5 days from the day after the arrival date
    • Used, altered, laundered, or cleaned products
    • Products with the brand tags removed or missing accessories
    • Products that have acquired odors, stains, or scratches in customer’s possession
    • Products with significantly different conditions upon return compared to the time of delivery (including the box and accessories)
    • Other non-returnable items
※ If you are returning the item from overseas, please note that the shipping costs will be borne by you.

 

Article 13(Notification or Communication)

  1. Notifications or communications between the Users and the Company shall be made in the manner prescribed by the Company.

 Article 14(Prohibition of Transfer of Rights and Obligations)

  1. The Users shall not transfer or pledge to a third party any rights or obligations based on the use contract or these Terms of Use without the prior written consent of the Company.

 Article 15 (Governing Law and Jurisdiction)

  1. The interpretation of these Terms of Use shall be governed by Japanese law.
  2. In the event of a dispute related to the Service, the exclusive jurisdiction shall be the court located at the Company's head office.

この利用規約（以下，「本規約」といいます。）は，RISA wonders（以下，「当社」といいます。）がこのウェブサイト上で提供するオンラインショップ（以下，「本サービス」といいます。）の利用条件を定めるものです。登録ユーザーの皆さま（以下，「ユーザー」といいます。）には，本規約に従って，本サービスをご利用いただきます。

第1条（適用・本規約の変更）

  1. 本規約は，ユーザーと当社との間の本サービスの利用に関わる一切の関係に適用されるものとします。
  2. ユーザーは利用登録申請をすることにより、本規約に同意したものとみなされます。
  3. 当社は、任意に本規約を変更することができ、当該変更の内容を当社所定の方法により告知することにより当該変更の効力は告知によりただちに生じるものとします。

第2条（利用登録）

  1. 利用登録は、登録希望者が当社の定める方法によって利用登録を申請し，当社が当社の定める基準に従って登録の可否を判断し、これを承認する通知をすることによって，完了するものとします。
  2. 当社は，利用登録の申請者に以下の事由があると判断した場合，利用登録の申請を承認しないことがあり，その理由については一切の開示義務を負わないものとします。
  3. 当社に提供した登録事項の全部または一部につき虚偽、誤記または記載漏れがあった場合
  4. 未成年者、成年被後見人、被保佐人または被補助人のいずれかであり、法定代理人、後見人、保佐人または補助人の同意等を得ていなかった場合
  5. 反社会的勢力等（暴力団、暴力団員、右翼団体、反社会的勢力、その他これに準ずる者を意味します。以下同じ。）である、または資金提供その他を通じて反社会的勢力等の維持、運営もしくは経営に協力もしくは関与する等反社会的勢力等との何らかの交流もしくは関与を行っていると当社が判断した場合
  6. 登録希望者が過去当社との契約に違反した者またはその関係者であると当社が判断した場合
  7. 第8条の措置を受けたことがある場合
  8. その他，当社が当該利用登録を承認することが適当でないと判断した場合

第3条（ユーザーIDおよびパスワードの管理）

  1. ユーザーは，自己の責任において，本サービスのユーザーIDおよびパスワードを管理するものとします。
  2. ユーザーは，いかなる場合にも，ユーザーIDおよびパスワードを第三者に譲渡または貸与することはできません。当社は，ユーザーIDとパスワードの組み合わせが登録情報と一致してログインされた場合には，そのユーザーIDを登録しているユーザー自身による利用とみなします。
  3. ユーザーIDまたはパスワードの管理不十分、使用上の過誤、第三者の使用等によって生じた損害に関する責任はユーザーが負うものとし、当社は一切の責任を負いません。

第4条（利用料金および支払方法）

  1. ユーザーは，本サービス利用の対価として，当社が別途定め，本ウェブサイトに表示する利用料金を，当社が指定する方法により支払うものとします。
  2. 当社は、本サービスの利用期間中、利用料金を変更することができます。
  3. ユーザーが利用料金の支払いを遅滞した場合には、ユーザーは年6%の割合による遅延損害金を支払うものとします。

第5条（本サービスの利用）

本サービス利用条件は以下の通りとします。

  1. 配送料および代引き手数料：別記に定める通りとします。
  2. 契約の成立時点：当社から「注文確認メール」が送信された時点とします。
  3. お買い上げ伝票：「注文確定メール」をもって代えさせていただきます。

第6条（禁止事項）

ユーザーは，本サービスの利用にあたり，以下の行為をしてはなりません。

  1. 法令または公序良俗に違反する行為
  2. 犯罪行為に関連する行為
  3. 当社のサーバーまたはネットワークの機能を破壊したり，妨害したりする行為
  4. 当社のサービスの運営を妨害するおそれのある行為
  5. 他のユーザーに関する個人情報等を収集または蓄積する行為
  6. 他のユーザーに成りすます行為
  7. 当社のサービスに関連して，反社会的勢力に対して直接または間接に利益を供与する行為
  8. 本サービスの利用目的に反する行為
  9. その他，ユーザーの行為により当社による本サービスの提供に支障が生じる場合、ユーザーが利用を継続することにより当社又は第三者に損害が生じる恐れがある場合等、当社が不適切と判断する行為

第7条（本サービスの提供の停止等）

  1. 当社は，以下のいずれかの事由があると判断した場合，ユーザーに事前に通知することなく本サービスの全部または一部の提供を停止または中断することができるものとします。
    • 本サービスにかかるコンピュータシステムの保守点検または更新を行う場合
    • 地震，落雷，火災，停電または天災などの不可抗力により，本サービスの提供が困難となった場合
    • コンピュータまたは通信回線等が事故により停止した場合
    • その他，当社が本サービスの提供が困難と判断した場合
  2. 当社は，本サービスの提供の停止または中断により，ユーザーまたは第三者が被った不利益または損害について，当社に故意・重過失がない限り、責任を負わないものとします。

第8条（利用制限および登録抹消）

  1. 当社は，本条に基づき当社が行った行為によりユーザーに生じた損害について，一切の責任を負いません。
  2. 当社は，以下の場合には，事前の通知なく，ユーザーに対して，本サービスの全部もしくは一部の利用を制限し，またはユーザーとしての登録を抹消することができるものとします。
    • 本規約のいずれかの条項に違反した場合
    • 登録事項に虚偽の事実があることが判明した場合
    • その他，当社が本サービスの利用を適当でないと判断した場合

第9条（免責事項）

  1. 当社の債務不履行責任その他一切の責任は，当社の故意または重過失によらない場合には免責されるものとします。
  2. 当社は，何らかの理由によって責任を負う場合にも，通常生じうる損害の範囲内かつ有料サービスにおいては代金額（継続的サービスの場合には1か月分相当額）の範囲内においてのみ賠償の責任を負うものとします。
  3. 当社は，本サービスに関して，ユーザーと他のユーザーまたは第三者との間において生じた取引，連絡または紛争等について一切責任を負いません。

第10条（サービス内容の変更等）

  1. 当社は，ユーザーに通知することなく，本サービスの内容を変更しまたは本サービスの提供を中止することができるものとし，これによってユーザーに生じた損害について一切の責任を負いません。

第11条（決済について）

  1. 決済方法は、以下のいずれかをご利用できます。
    • クレジット決済（MASTER、VISA、American Express）
    • Shop Pay
    • Apple Pay
    • Google Pay
    • Bancontact
    • iDEAL

2.　決済の支払期限は、以下の通りになります。

  1. クレジット決済：即時決済となります。なお、注文や予約を頂いた日が決済完了日ですが購入データは購入月の月末反映となります。決済業者やクレジットカード会社の決済時期及び支払時期・各種手数料・その他条件に関しましては、各種決済業者またはクレジットカード会社のWEBサイト等にてご確認ください。

第12条（返品・交換について）

  1. ご注文後の内容変更・キャンセル、ご注文内容の誤り、開封後のイメージと違う等お客様のご都合による商品の交換・返品は承っておりません。
  2. 商品のお届けには万全を期しておりますが、万が一、当社の落ち度・責任により、届いた商品が汚損または破損していた場合や、ご注文いただいた商品と違っていた場合は、問い合わせフォームから当社へご連絡頂き、当社からお届けした商品を国内の場合は着払いで当社にご返送ください。返品受領後、当社の送料負担にて速やかに良品・正品と交換させていただきます。代替商品が手配できない場合、代金を返金いたします。なお、この場合であっても、以下の商品については返品をお受けできませんのでご注意ください。
    • 到着日の翌日から 5日以内に当社にご連絡いただけなかった場合
    • 使用済み、あるいはリフォームや洗濯、クリーニングされた商品
    • ブランドタグを切り離したり、付属品を紛失された商品
    • お客様のもとでニオイが付着したり、汚れ・キズが生じた商品
    • ご返送時の商品状態がお届け時と著しく異なっている商品(箱・付属品も含む)
    • その他、返品対象外商品

※海外からご返送の場合は送料はお客様負担でお願いいたします。

 第13条（通知または連絡）

  1. ユーザーと当社との間の通知または連絡は，当社の定める方法によって行うものとします。

第14条（権利義務の譲渡の禁止）

  1. ユーザーは，当社の書面による事前の承諾なく，利用契約上の地位または本規約に基づく権利もしくは義務を第三者に譲渡し，または担保に供することはできません。

第16条（準拠法・裁判管轄）

  1. 本規約の解釈にあたっては，日本法を準拠法とします。

本サービスに関して紛争が生じた場合には，当社の本店所在地を管轄する裁判所を専属的合意管轄とします。
